SC Flags 14 Defects in Rahul Gandhi’s Petition Against Election Commission
The Supreme Court registry has flagged 14 procedural defects in the writ petition filed jointly by Leader of Opposition Rahul Gandhi and 10 other INDIA bloc leaders against the Election Commission of India.
The petition challenges alleged voter deletions and procedural irregularities in the Election Commission's Special Intensive Revision of electoral rolls, seeking an independent audit committee and an interim stay on the process.
Among the administrative flaws highlighted in the registry's office report is a court fee deficit of ₹220, alongside the missing signed legal authorisations, or vakalatnamas, for nine co-petitioners, including Akhilesh Yadav, Tejashwi Yadav, Sanjay Raut, Supriya Sule, and Saugata Roy.
The registry also pointed out documentary shortcomings, such as an illegible copy of Congress President Mallikarjun Kharge’s identity card, unclear supporting annexures, and a requirement to submit soft copies of key orders on a pen drive.
Additionally, the registry sought clarification regarding the legal basis for naming individual Election Commissioners, including Chief Election Commissioner Gyanesh Kumar, as private respondents in a writ petition filed under Article 32.
These objections pertain purely to administrative filing requirements, and the Supreme Court will schedule the matter for a judicial hearing once the legal team cures all 14 defects.
