Supreme Court Clarifies NEET Protest Orders: States Free to Withdraw FIRs, Bar on Heinous Crimes
The Supreme Court has clarified that state governments and the NCT of Delhi hold the legal liberty to withdraw or close First Information Reports (FIRs) registered against participants of the nationwide NEET-UG paper leak demonstrations.
A bench comprising Chief Justice Surya Kant, Justice Joymalya Bagchi, and Justice V. Mohana explicitly ruled that the phrase "criminal antecedents" must be strictly restricted to individuals involved in grave and heinous offenses.
While peaceful student demonstrators and first-time participants facing minor infractions will receive relief and avoid coercive actions, the exemption does not apply to hardened criminals or those implicated in severe acts of violence and vandalism during the protests.
Furthermore, the apex court has instructed authorities to systematically segregate pending cases into distinct categories to ensure student futures are not jeopardized while maintaining strict accountability for serious offenses.
