U.S. Weighs Ending 60-Day Grace Period for Laid-Off H-1B Workers
The United States is reviewing a proposal to eliminate the 60-day grace period that currently allows laid-off foreign workers and their dependents to remain in the country to find new employment.
Currently, non-immigrant workers on visas like H-1B, L-1, and O-1 have up to 60 days post-termination to secure a new job, file a change of status, or depart.
If finalized, the new rule would strip away this timeline, potentially forcing affected individuals to leave the U.S. immediately upon job loss.
This prospective policy change carries immense implications for the Indian expat community, who comprise roughly 71% of all H-1B beneficiaries.
Currently under review by the White House Office of Management and Budget (OMB), the proposal is not yet active law.
It must undergo public review and rulemaking phases before any potential implementation, leaving the existing 60-day safeguard fully operational for now.
