India Weighs Revoking Safe Harbour Immunity for Tech Giants

The Indian government is considering a major policy shift: removing or significantly restricting the "safe harbour" legal immunity currently granted to social media platforms under Section 79 of the Information Technology Act, 2000.

Under existing rules, platforms like X, Meta, and YouTube are shielded from legal liability for user-generated content, provided they comply with standard takedown directives.

However, officials argue that modern algorithms actively curate, rank, and amplify content for engagement, making platforms function more like publishers than passive intermediaries.

Spurred by the rapid rise of AI deepfakes, non-consensual imagery, and online misinformation, the proposed overhaul aims to enforce stricter compliance and establish direct user grievance mechanisms.

If safe harbour protections are revoked through parliamentary amendments, tech companies could face direct legal liability for harmful or unlawful content hosted on their platforms.
